Would This Be A Form of Occupation?

Hate preacher Abu Hamza’s wife has been asked to move from her £1 million council home to a smaller property but council officials have conceded they have no legal powers to force her to go.
It came as the extremist cleric was due to appear in a New York court today to enter a plea on terrorism charges after a protracted legal battle to stay in Britain.
At their five-bedroom former family home in Shepherd’s Bush, officials are keen to move his wife, Najat Mostafa, into a flat because just two of their eight children live at home.
Neighbours yesterday joined the local MP Greg Hands to ask Mrs Mostafa, 53, to move, saying she was “rattling around” the house when young large families could use the room and she should consider a small flat nearby.
Tory-run Hammersmith and Fulham council has written to Mrs Mostafa, Hamza’s second wife, asking her to move to a “more appropriate property”.
But she is not legally compelled to do so and there is no time limit on her tenancy agreement on the property, where she has lived since 1995.
Hammersmith and Fulham council has 10,000 on its housing waiting list and says “under-occupation” is a growing problem.
A council spokesman said: “I can confirm that we have corresponded with Mrs Mostafa with regards to her tenancy.
“We believe this home is too big for the number of family members who currently live there and, with over 10,000 people languishing on the borough’s housing waiting list, she should move to a more appropriate property.”
